内容記述 In juvenile protection proceedings, juveniles occupy a dual position. On the one hand, they are required to explain their own actions and circumstances; on the other hand, they are treated as objects of investigation and assessment by the court. Under such conditions, juveniles often lack the capacity to effectively protect their own interests, particularly in proceedings that may result in adverse dispositions.
 The role of the attendant counsel is to help ensure that juveniles receive treatment conducive to their sound development, in accordance with the principles of juvenile law. This role includes supplementing or articulating the views of juveniles, who are generally immature both cognitively and linguistically. However, representation by attendant counsel inevitably raises certain difficulties. One issue concerns how the attendant translates a juvenile’s statements—often expressed in immature or ambiguous language—into legally meaningful terms. Another issue arises when the juvenile exercises the right to remain silent: the attendant must then determine how to evaluate and articulate the juvenile’s intentional silence.
 Although attendant counsel seeks to protect the rights and interests of juveniles through representation, such representation may blur the boundary between the juvenile’s own will and the attendant’s interpretation, thereby risking an undue substitution of the juvenile’s right to self-determination. Nevertheless, representation by attendant counsel is unavoidable in juvenile protection proceedings. Rather than attempting to eliminate representation, it is therefore necessary to address and manage the tensions inherent in it.
 This article argues that these tensions can be alleviated by emphasizing procedural safeguards that ensure meaningful participation by juveniles in the decision-making process, provide explanations that are understandable to them, and reflect their expressed views, without treating those views as absolute or determinative.
