| 内容記述 | The problem of the school accident cannot be denied to have a great influence on a teacher in addition to the continuation of school system itself. Therefore, it is necessary to clarify what torts liability a teacher should have. This article analyzes the type of torts liability a teacher owes and extracts a problem concerning it. The torts liability of a teacher is composed of the breaches of three duties; the duty of care, the safe consideration duty, and the supervisory duty to school children. There remains an essential problem of the confusion of those duty concepts leading to the unlimited liability on a school teacher to the school accident. To avoid this problem, this article concludes that clarification on the obligatory relation between parents and a teacher should be done. | |||||||||
