| 内容記述 | カナダのケベック州で1979年にクラスアクションが導入され以来、約30年が経過した。消費者保護を目的として集団への損害賠償を可能にしたこの制度は、３つの段階を経て現在に至っている。クラスアクションを拒絶する段階、クラスアクションを広く許容する段階、そして現在のクラスアクションを選別する段階である。わが国と同様の大陸法体系を採用するケベック州は、アメリカ連邦民事訴訟規則と類似したクラスアクション規定をもつが、クラスアクション認可において広範な司法裁量を認める。このようにコモン・ロー体系とは異なる特徴を持ちながら、ケベック州はカナダのコモン・ロー州のクラスアクションに触発されながら、クラスアクションの優越性を媒介にしてこの制度を根付かせている。 | |||||||||

| 内容記述 | Class Action was introduced in Quebec in 1979 to enable consumers, whose individual claims were small, to claim collective recovery of damages. The Province of Quebec with a civil law system was the first jurisdiction that had introduced class action outside common law jurisdictions. To institute class action, the plaintiff must obtain court authorization. Authorization for class action is almost the same as the certification process in US federal court. Comparing with Federal Rules of Civil Procedure, Quebec Civil Procedure allows judges to exercise wide discretion for authorizing class action. The judicial discretion has marked three stages since the adoption of class action in Quebec; the first exceptional stage having special attitudes towards class action, the second liberal stage reflecting a desire for class action, the third rigorous stage filtering and verifying class action under the spirit of judicial balancing. Quebec’s class action phase has coincided with the emergence of growing class action cases from common law jurisdictions in Canada. Quebec continues to stand apart as a civil law system with the importation of some extrinsic ideas and practices from common law jurisdictions by through the concept of predominance of class action. | |||||||||
