内容記述 | 連邦民事訴訟規則ではそのRule 23において、クラスを代表する者はクラス・アクションの提起にあたり、適切にその他のクラス構成員を代表しなければならない旨の要件が定められている。この要件は、クラス代表者ではない出廷しないクラス構成員への適正手続を保障する目的がある。そこで、これを実現して、クラス・アクションにおいて適切な代表になるためには、クラス代表とクラス構成員間での利害対立の不在、およびクラス代表それ自身が公正かつ精力的に訴訟を追行する能力が必要となる。 | |||||||||

内容記述 | Federal Rules of Civil Procedure Rule 23(a)(4), the "adequacy of representation" requirement, provides that the representative parties in class actions must fairly and adequately advance and protect the legal rights of absent class members. The adequacy of the representation of the class is the linchpin to securing preclusive effect of the class proceedings as to absent members. The adequacy requirement serves to uncover conflicts of interest between the named plaintiffs and the class they seek to represent. The binding effect of a class judgment (res judicata) on absent class members who have not entered an appearance results from consideration of due process. In certain cases, principally ones predominantly seeking monetary relief, adequate representation also requires notice of the pendency of the class action to the members of the putative class. A class representative has a fiduciary duty to promote and protect the interests of the class he or she purports to represent. The class representative's fiduciary duties to the other members of the class unquestionably attach upon class certification. The requirement of adequate representation has two components. First, the court must determine whether the representative plaintiffs and their counsel have any conflicts of interest with other class members, i.e., their interests with respect to the case are aligned. Conflict must not be speculative and relate to subject matter of action. Second, the court must satisfy itself that the representative plaintiffs and their counsel understand that they are acting in a representative capacity and will prosecute the action throughout its duration fairly, vigorously, and competently on behalf of the class. Representative plaintiff should be familiar with action and not delay certification. In sum, Adequacy of representation is perhaps the most significant of the prerequisites to a determination of class certification. | |||||||||
